SUMMARY OF January 8, 2008 Budget Meeting

Dear Fellow BSBCCA Members,

The following summary of the January 8, 2008  Budget Meeting was approved at the Board meeting of February 19, 2008

  1. John Coletti opened the meeting by reminding the members present that the by-laws state that the budget proposed by the Board of Directors can only be voted down by a majority of the weighted votes by unit owners and with 15 members present and only 77.5 weighted votes, the votes to overturn the budget were not present and so the budget passes.
  2. Bill Emby (Unit 240) stated that he would like a rear window installed in his cabana.  John Coletti told him that the Board would only allow it if the majority of unit owners on that row agreed to also have rear windows installed as to not compromise the esthetics of the building.
  3. John Andrews (QN25) asked if a color scheme had been chosen for the painting project.  John told him that there are several samples being considered.
  4. Marybeth Holland (53) asked if our maintenance staff would be assisting in the painting.  John Coletti and Joe Mignano explained that our maintenance staff would not be doing any of the painting because they have the large task of repairing and replacing all of the missing, broken, or rotted shingles, deck boards, and railings.  They also have many projects to complete before we open in May.  For example:  remodeling two bathrooms, remodeling the kitchen, rebuilding two decks, and general maintenance in all areas.  It should also be noted that there would be an issue with the warrantee if some areas were painted by our staff and some by the painter.
  5. We will be running the food services again this year and are currently interviewing for a new chef.
  6. It was noted that the noise level in the restaurant is too loud.  Joe told the group that we are continuing to search for a solution.
  7. Lee Vick (326) suggested that we add a few more handicap parking.  John told him that the Board plans on discussing the possibility of adding some spaces.
  8. Lee Listro (F07) asked how we stand with the legal case with the developer.  John reported that there were two legal cases still pending.  The first case is now in the Supreme Court case where the developer sued stating that is was wrongfully denied the right to participate in the ISDS system.  This case asks for an award of damages.
  9. The second case concerns Heath Management’s recent attempt to exercise the development rights.  First, Heath filed several applications with DEM in an attempt to increase the size of the ISDS system to accommodate more units.  Also the developer entered the facility ostensibly to clean out the sales office but instead they brought in 130 lockers in the old sales office that had been declared as units.  We are told they plan to sell the units for $8,000.00 each.  The town has sent them a letter ordering them to remove the lockers because they were not approved by DEM.  This is subject to appeal so they won’t be removed soon.  The Association has also filed a suit in US District Court challenging the declaration of those units.  We have been talking to the developers about the possibility of buying out the development rights.  Both parties are spending tens of thousands of dollars on legal fees with this fight.  The Board believes that buying the development rights is a viable option that should be seriously pursued.
  10. Another member asked about the suit against the Town of Narragansett regarding property taxes and John reported that it was still pending.  If we win, they would owe us a refund of back taxes.  We are unique in the state in that no other condo facility exists like BSBC.  It was suggested that we could offer no return of past monies paid and instead only opt for a change to a lower rate going forward and this is a very real possibility.
  11. Marybeth Holland (53) reported she had received the breakdown of the payroll from 2006 and she revealed what some of the staff was earning.  John Coletti reported that we will need to spend more on lifeguards this year.  She will be requesting an accounting for 2007 payroll. John reported that we have also searched for candidates for the GM position and did not receive any quality candidates.
  12. A member asked if we really felt we needed more or better security.  The Board response was that we need both.
